Who decides the morality of the books then?
Presumably whichever judge ends up trying the case. Fortunately this is only state law, so there’s less shopping around possible than happens with federal crimes, but I imagine the whole point of this law is to give the Fundies an opportunity to prosecute bookstores for selling books that they don’t like, and I don’t suppose they would have bothered if they didn’t know they had a sympathetic judge or two lined up.
I see from the Star’s coverage that a book only has to describe sexual conduct to be covered, so any book on sex education, for example, would be subject to this law. And, as the Star points out, so would The Bible and the works of Shakespeare.
